He could only sue her if he got hurt due to anything that happened after she come into contact with him. Once she undertakes to rescue him, she takes on a legal duty to see that rescue through, and any injury he suffers is on her. However, Since he did jump down, his negligence compared to any she might have would probably weigh against him and so she wouldn`t have to pay. It`s only in cases where someone would have been better off had the rescuer not intervened that they can be successful in getting damages for negligence. The law`s not as bad as the few headlines say. It`s only the "seemingly" extreme cases that make the news. The media hardly ever reports ALL the material facts in a case, and oftentimes the smallest fact can determine whether someone is liable or not.

She is a hero, and a court would find as such. If he lost a leg, well, that would be on him if he struggled against her while he was on the tracks. The fact that he voluntarily placed himself in peril automatically makes him more negligent than her in pulling him to safety.

And the suit seeming so frivolous would probably end in him owing her for costs of litigation.
