a man whose relatives say had been sniffing gasoline was engulfed in flames after a police officer tasered him as he ran at officials carrying a container of fuel, police said tuesday.

the man, identified by his family as 36-year-old ronald mitchell, was in critical condition at a perth hospital in western australia state following monday's incident in warburton, an aboriginal community 950 miles northeast of perth.

western australia police said they were responding to a complaint at a house when mitchell ran outside carrying a cigarette lighter and a large plastic bottle containing what they believe was fuel. when he refused to stop running toward them, one officer tasered him, police said in a statement.

the man immediately burst into flames. the officer threw him to the ground and smothered the blaze with his hands, the statement said. mitchell was charged with assault to prevent arrest and possession of a sniffing substance.

an 18-year-old woman threw rocks at the officer as he tried to help, and he was later treated for a cut on his head and burns to his hands, police said.

the woman was charged with two counts of assaulting an officer, police sgt. graham clifford said. two others at the house were charged with possessing a sniffing substance.

mitchell's sister, morinda west, told the australian newspaper that her brother had been sniffing gasoline and that when he ran out of the house he was carrying a lighter and an orange juice container full of gasoline.

police spokeswoman susan usher said mitchell appeared to have received third-degree burns to about ten percent of his body.

western australia police commissioner karl o'callaghan defended the officer's actions on tuesday, calling mitchell a known gasoline sniffer and violent offender.

"the police officers were concerned that they were going to be burnt so they deployed a taser," o'callaghan told reporters in perth. "the only other choice they would have had is to use a police-issue firearm and the circumstances would almost certainly have been far more grave."

o'callaghan also said that while mitchell did burst into flames after the taser was deployed, it wasn't immediately clear if the stun gun actually sparked the fire.

"there is a very strong possibility the fire was caused by the lighter in the hand of the offender," he said.

the officer who tasered mitchell was not suspended, clifford said.

in the nsw (australian new south wales) supreme court today, justice michael adams ruled a fictional cartoon character was a "person" within the meaning of the relevant state and commonwealth laws.

in february, alan john mcewan was convicted in parramatta local court of possessing child pornography and using his computer to access child pornography.

"the alleged pornography comprised a series of cartoons depicting figures modelled on members of the television animated series the simpsons," the judge said.

the cartoons showed characters such as bart, lisa and maggie simpson having sex.

the man was convicted and fined $3,000 and placed on a good behaviour bond.

"in my view, the magistrate was correct in determining that, in respect of both the commonwealth and the nsw offences, the word 'person' included fictional or imaginary characters ...," the judge said.

"... the mere fact that the figure depicted departed from a realistic representation in some respects of a human being did not mean that such a figure was not a 'person'."

in dismissing the appeal, the judge ordered each party to pay its own legal costs as this was the first case dealing with this "difficult" issue.

in a statement released wednesday, the new south wales state food authority said the glowing phenomenon is caused by a harmless light-emitting bacteria that is naturally present in most meats and fish.

"while most of us would understandably be shocked to see our food glowing, it is important to remember that the microorganism responsible for the glow is not known to cause food poisoning," the authority's director general, george davey, said in the statement.

the food authority receives around two phone calls each month from nervous consumers who have discovered glowing meats in their iceboxes. it issued the statement to allay fears about possible radioactivity in australia's meat supply.

"there has been some speculation in the media that glowing food might have been irradiated, and i can assure consumers that this is definitely not the case," davey said.

the adf's internal recruiting plan for 2005-2010, obtained by the australian, warns that overuse of recreational drugs -- particularly marijuana -- among 15-year-olds, and junkfood-related obesity in the young are expected to worsen over the next decade.

"the high incidence of non-medical drug use among young people (recent studies suggesting up to 50 per cent of 15-year-olds smoke marijuana at least once a month) ... severely limits the pool of recruitable candidates," says the adf recruiting report, completed last month.

and it warns that the obesity problem is "expected to worsen over time as australian society reflects the phenomenon found in developed nations".

one in 12 military candidates already fail the physical or mental fitness tests, and overall the adf fell 1000 short of its recruitment targets last year.

the report says the rate of childhood obesity in australia is "one of the highest among developed nations", with 25 per cent of children assessed as overweight or obese, up from 5 per cent in 1965.

senator hill will unveil this week a strategy to expand the force to almost 55,000 to meet the challenges of the global war on terror. as part of the plan, he wants the army to recruit an extra 2500 personnel.

labor defence spokesman robert mcclelland said senator hill had "buckley's chance" of boosting defence force numbers, given the pressures on defence force recruiting.

"unless there is major shift in the way the defence force treats its young people, it is going to be a struggle," mr mcclelland told the australian. "military justice, remuneration and postings are all issues that need to be addressed."

mr mcclelland said education on diet, government-subsidised subscriptions for children's sport and incentives for teachers to coach should all be part of a co-ordinated plan to tackle obesity and drug abuse in the community.

"that would not only improve the health of the community but have a flow-on effect to rates of defence force recruiting," he said.

australia defence association executive director neil james said the force ought to be applauded for "publicly confronting drug abuse and obesity, which are cruelling its recruiting efforts".

"while you are still getting the same proportion of people interested in joining the defence force as you always did, more of them are failing the psychological and physical entry tests," he said.

local sergeant steve watt said a 29-year-old australian man was taken home by police in a dressing gown on the weekend after being woken by hotel staff.

"he was a bit surprised that there were two people in his room and he was butt naked," mr watt told the new zealand’s southland times.

the man said that a woman had escorted him to the hotel but he had wondered out of her room throughout the night and into another room, occupied by the husband and wife, and went to sleep.

the couple alerted the hotel, and the man was not charged.

“it was far too funny,” mr watt said.

the national drug and alcohol research council study of 1,500 australians found that some 58 percent of people agreed that sometimes having too much to drink was "simply part of the australian way of life."

the survey found that about one in 10 people had a problem with alcohol at some point in their lives and that about 60 percent were close to someone who had experienced a drinking problem.

the study also found that 17 percent of those interviewed said that they sometimes felt pressure to drink alcohol while in a work situation.

paul dillon, information manager with the council, said the findings showed that australians appeared to be having their first alcoholic drink at a younger age than previously.

the study found that 54 percent of respondents had their first alcoholic drink when under the legal drinking age of 18, with people in the 30 and under age group saying they had their first drink when they were only 10-12.

dillon said while australians had been successful in banning smoking in most public places, the community was not ready to sever its ties to booze.

"australians are not ready yet to make that big leap that we've seen with tobacco," he told afp.

"i don't think the community is ready for a wave against alcohol. it really is part of our culture," he said.

most australians interviewed for the survey said they did not think that warning labels on bottles would encourage people to drink less.
